Delhi Pollution Control Committee

The Delhi Pollution Control Committee (DPCC) is the primary agency in Delhi State responsible for implementation of the Air (Prevention and Control of Pollution) Act, 1981, the Water (Prevention and Control of Pollution) Act, 1974 and the Environment Protection Act, 1986. The DPCC has entrusted with the task of prevention, control and abatement of pollution under various provisions of these Acts. The DPCC also acts as a co-ordinating agency for enforcement of environmental laws in Delhi so that there is no duplication of effort on the part of Central Pollution Control Board (CPCB), Municipal Corporation of Delhi (MCD), New Delhi Municipal Committee (NDMC), New Delhi Municipal Council (NDMC), DSIIDC and other agencies.

What is DPCC?

DPCC is one of the most important documents which need to obtain while setting up a business. It stands for Delhi Pollution Control Committee and it is responsible for monitoring and controlling the pollution level in Delhi NCR. The committee has established under the Water (Prevention and Control of Pollution) Act, 1974.

Overview of Delhi Pollution Control Committee (DPCC)

The Delhi Pollution Control Committee (DPCC) was constituted in 1991, under the provisions of the Water (Prevention and Control of Pollution) Act, 1974, as amended up to date. The main functions of the Committee are described below:

  • Administration of the Water (Prevention and Control of Pollution) Act, 1974.
  • Administration of the Air (Prevention and Control of Pollution) Act, 1981.
  • Granting consent for establishment and operation to industries/hotels/restaurants etc.
  • Periodical monitoring of water and air quality at identified locations in NCT of Delhi.
  • Periodical inspection/audit of industrial establishments having consent to operate from DPCC.
  • Sampling and analysis of ambient air quality at identified locations in NCT of Delhi.
  • Sampling and analysis for water quality at identified locations in NCT of Delhi.

The main functions of the DPCC are:

  1. To provide financial assistance for flood control and drainage schemes.
  2. To lay down standards in regard to technical specifications, workmanship, materials and quality control of the construction works executed by implementing agencies.
  3. Provide necessary funds for development of land acquired for the purpose of flood control and drainage schemes.
  4. To coordinate the planning of flood control and drainage schemes with other development programmes.

The DPCC main functions are:

  • To monitor ambient air quality at designated locations in the city for gaseous and particulate pollutants.
  • Review and approve action plans for pollution abatement submitted by industries, hospitals and local bodies in the city.
  • To coordinate with Delhi Pollution Control Committee (DPCC) in respect of industries operating in Delhi.
  • Identify areas with high air pollution levels and to bring these to the notice of Central Pollution Control Board (CPCB), Government of NCT of Delhi (GNCTD), Municipal Corporation of Delhi (MCD), New Delhi Municipal Council (NDMC), etc. and take remedial steps to reduce the pollution levels.
  • To study trends in air quality and recommend measures to improve air quality.
  • To liaise with CPCB, GNCTD, MCD, NDMC, etc., for implementation of recommendations regarding improvement of air quality.

Why DPCC NOC/Consent Certificate required?

As per the Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974, it is mandatory for any industrial unit to get NOC/Consent Certificate from the DPCC before starting operation.

Who needs to take DPCC NOC/Consent?

All existing as well as new industries located in NCT of Delhi need to obtain NOC/Consent Certificate from DPCC for the operation of their units.

Importance of DPCC NOC/Consent Certificate

What is DPCC NOC/Consent Certificate?

Any business which produces smoke or air pollution can ask to acquire a Consent Certificate from the DPCC. The certificate acts as a permission for operating any industry or business in the area which has an adverse impact on the environment. The industries are categorized into three categories – Red, Orange & Green. Depending on the category, different parameters and requirements are set for obtaining this certificate.

Documents Required to Apply for DPCC NOC/Consent Certificate

  • Application Form
  • Project Report
  • Site Plan
  • Details of machinery/equipment to use
  • Manufacturing process description with material balance
  • Details of raw material, fuel and water requirement
  • Pollution control measures to be adopted (list of pollution control equipment)
  • Details of effluent generation, storage and disposal system with flow chart in case of hazardous waste
  • Environmental Management Plan (EMP) including details of green belt development plan etc., as applicable

Following are some general guidelines for obtaining Consent Certificates in India:

  • The application must made to the State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) in Form 1 as per Schedule 1A of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 and EIA Notification, 2006.
  • The application must be accompanied by prescribed fees as per Schedule II of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. If the application reject by SPCB/PCC, then such amount shall refund to the applicant within a period not exceeding 3 months from the date of receipt of such application.
